TERMS OF SERVICE

1. Parties and Acceptance of Terms

These Terms of Service are entered into between Uçuş Tazmin Danışmanlık ve Teknoloji Limited Şirketi (“UçuşTazmin” or the “Company”) and the individual (“User” or “Passenger”) who accesses or uses the website www.ucustazmin.com.

By accessing the website or using our services, you are deemed to have accepted these Terms. If you do not agree, please do not use the service.

2. Scope of Service

UçuşTazmin pursues compensation claims arising from flight delays, cancellations, overbooking, and missed connections under:

EU Regulation 261/2004
SHY-PASSENGER Regulation (SHY-YOLCU)
Turkish Consumer Protection Law No. 6502
Relevant national and international regulations

Our services may include:

Compensation eligibility analysis
Application to the airline company
Mediation process
Enforcement proceedings
Litigation process
Collection and payment transfer

Where necessary, the Company may act under assignment of receivables or collection authorization.

3. Service Model and Fees

Our service operates on a success-based model.

A service fee, calculated as the percentage specified in the agreement, is deducted from the compensation amount successfully recovered.

If no recovery is obtained, no service fee is charged to the user (unless otherwise agreed in writing).

If judicial proceedings are initiated, court costs and expenses shall be determined in accordance with the agreement signed between the parties.

Service rates are explicitly stated in the separate agreement executed with the user.

4. User Obligations

The User agrees to:

Provide accurate and complete information
Avoid submitting fraudulent or duplicate claims
Submit flight documents truthfully
Not assign the same receivable to another entity simultaneously (unless otherwise agreed)
Cooperate with the Company throughout the process

The User shall be legally responsible for any consequences arising from misleading or false information.

5. Legal Proceedings

UçuşTazmin may act based on:

Assignment of receivables
Collection authorization
Contractual authority

The strategic assessment regarding initiation and conduct of legal proceedings shall be made by the Company.

6. No Guarantee of Success

The outcome of compensation claims depends on various factors, including:

Flight conditions
Force majeure evaluations
Airline defenses
Judicial discretion

Accordingly, no claim outcome is guaranteed.

7. Limitation of Liability

UçuşTazmin shall not be liable for:

Events beyond its control
Failure of airline companies to make payments
Decisions of judicial authorities
Force majeure events

The Company’s liability is limited to the amount successfully recovered, except in cases of gross negligence.

8. Intellectual Property

All content, design, software, logos, and texts on the website belong to UçuşTazmin and are protected under applicable legislation.

They may not be used, reproduced, or distributed without authorization.

9. Data Protection

The processing of personal data is governed by the Privacy Policy. By submitting an application, the User is deemed to have accepted the Privacy Policy.

10. Suspension and Termination of Service

The Company may suspend or terminate the service in the following cases:

Provision of misleading information
Breach of contract
Unlawful use
Conduct threatening system security

11. Governing Law and Jurisdiction

These Terms of Service shall be interpreted in accordance with the laws of the Republic of Türkiye.

In case of disputes:

For users acting as consumers, the competent Consumer Courts shall have jurisdiction.
In other cases, the Courts and Enforcement Offices of Istanbul Anatolian Side shall have jurisdiction.

12. Right to Amend

UçuşTazmin reserves the right to update these Terms of Service. The updated version enters into force on the date it is published on the website.
